RULES FOR SCHARLAB’s PHOTOGRAPHY CONTEST 2018
All those who work or carry out research in a laboratory and who are users of Scharlau® products, may participate by submitting one (1) photograph following the criteria stipulated in clause TWO as detailed below.
Employees of the organizing company SCHARLAB, any employee of any company belonging to the SCHARLAB Group or their respective relatives, ascendants, descendants, spouses or de facto partners, are excluded from participating in this contest.
TWO: PHOTOGRAPH REQUIREMENTS
In order to participate in this contest, the contestants must send a high resolution (300 dpi) landscape photograph, to SCHARLAB, in which one (1) or more of the Scharlau® brand products must appear. The product(s) must be clearly identified and should not appear in the photograph together with products of other brands.
Said photograph shall subsequently be published on SCHARLAB's official Instagram account, after review by SCHARLAB in order to verify that the requirements of the contest rules have been met. Said review shall be made by a SCHARLAB jury that reserves the right to discard photographs that do not meet the aforementioned requirements and that do not meet a minimum quality, or that may be deemed in bad taste or offensive. As such, the photographs submitted may be published on SCHARLAB's website and social networks, and may also be used for the Scharlab 2019 calendar and any other Scharlab advertising material.
Photographs that violate the right to honour, personal and family privacy and self-image, dignity of a person, the principle of non-discrimination on the basis of race, sex, religion, opinion, nationality, disability or any other personal or social circumstance, and/or violate any element or object protected by exclusivity, industrial or intellectual property rights, or any other right of third parties, as well as other principles that may be violated shall be rejected or excluded.
Each contestant may submit (1) a single photograph. In the event that SCHARLAB detects that more than (1) one photograph per participant has been uploaded, the second or subsequent photographs submitted shall be immediately deleted. In view of this situation, SCHARLAB shall only take into account, for the purpose of participation, the first of the photographs submitted by the participant.
The photograph must be sent to the following email address: firstname.lastname@example.org, together with the duly signed document ceding copyright and clearly indicating the data of the contestant, author of the photograph (name and surname, email address, contact telephone number and postal address).
If the contestant provides a photograph in which third persons other than the contestant appear, they (the contestant) shall guarantee that said persons appearing in the photograph are over the age of fourteen (14) and that the photograph has been taken with the consent and acceptance of the consequences of sending the photograph to SCHARLAB. The contestant is fully responsible for that stipulated herein and, consequently, SCHARLAB shall not be held responsible for any claim.
It is forbidden to publish photographs in which children under fourteen (14) years of age appear. If SCHARLAB detects that the photograph provided by the participant shows a child under the age of fourteen (14), said participation shall be cancelled and the photograph shall be immediately eliminated.
THREE: DATE OF RECEPTION OF PHOTOGRAPHS
The period for receiving photographs is established from 21st May to 20th July, 2018 inclusive.
From all the photographs submitted, the jury, formed by SCHARLAB professionals, shall be responsible for the selection of the photographs suitable for participation in the contest and their consequent publication in SCHARLAB's official account on Instagram.
The photographs submitted shall be evaluated according to the following criteria:
- Best concept expression
Any photograph that has political, racist, or sexist connotations, that approves of terrorism or directly or indirectly attacks any religion shall be immediately rejected.
Only those photographs selected shall be published on the SCHARLAB website, through Instagram and shall be published on those social networks where SCHARLAB has an account.
The photographs received may be edited and used for the promotion of the Scharlau® brand itself. The authors, senders or people that appear in them, shall only be rewarded through the prize.
SCHARLAB shall not negotiate with said photograph(s) under any circumstance.
FIVE: CHOOSING THE WINNING PHOTOGRAPHS
There shall be one (1) winning photograph. The winning photograph shall be the most voted by the jury comprised by SCHARLAB’s sales team which shall be chaired by the Managing Director or a person delegated by them.
Contestants may also cast a non-binding vote for the photographs of other participants by sending an email to email@example.com before 30th July, 2018.
There shall be 4 additional prizes according to the type of product presented in the photograph:
- Chemical and Extrabond Prize
- Microbiology Prize
- Glassware Prize
- Plastics and Filtration Prize
There shall be a prize dedicated to the professional use of a produict:
- Prize for the professional use of a product
These prizes will be awarded regarding the votes cast in the general voting.
Contestants must indicate to which category of the additional prizes they are presenting. They can opt for a maximum of two prizes, that of the winning photograph and one of the product or application prizes.
The result of the winners shall be announced on 7th September, 2018, SCHARLAB reserving the right to modify said date if necessary. In any case, the result of the contest shall be communicated personally to the winning contestants and shall be later published on the SCHARLAB website.
The amounts for the prizes shall be:
- Prize for the best photograph: five hundred (500) euros, as well as a voucher to the value of five hundred (500) euros, VAT Included, in Scharlau® brand products for the centre where the winner is employed to be used on a research and/or development project.
- Chemical and Extrabond Prize: two hundred (200) euros, as well as a voucher to the value of two hundred (200) euros, VAT Included, in Scharlau® brand chemical and Extrabond products for the centre where the winner is employed to be used on a research and/or development project.
- Microbiology Prize: two hundred (200) euros, as well as a voucher to the value of two hundred (200) euros, VAT Included, in Scharlau® brand microbiology products for the centre where the winner is employed to be used on a research and/or development project.
- Glassware Prize: two hundred (200) euros, as well as a voucher to the value of two hundred (200) euros, VAT Included, in Scharlau® brand glassware products for the centre where the winner is employed to be used on a research and/or development project.
- Plastics and Filtration Prize: two hundred (200) euros, as well as a voucher to the value of two hundred (200) euros, VAT Included, in Scharlau® brand plastic and filtration products for the centre where the winner is employed to be used on a research and/or development project.
- Prize for the professional use of a product: two hundred (200) euros, as well as a voucher to the value of two hundred (200) euros, VAT Included, in Scharlau® brand products for the centre where the winner is employed to be used on a research and/or development project.
The prize shall be awarded within six (6) months from the end date of the contest, either at the SCHARLAB headquarters or at the workplace of the winning team, provided this is authorized by the management of centre and that it is within the territory of Spain. SCHARLAB shall make two (2) attempts to award the prize to the winner, if said attempts are not successful for reasons attributable to the winner, the winner shall lose all rights to receive the prize as well as to exercise any related claim.
Tax deductions or account expenses shall be applied to the prize(s) as required by current fiscal legislation. SCHARLAB shall be responsible for carrying out the deposit of the amount(s) in the account(s) or the corresponding tax deductions.
The prize is personal and non-transferable, awarding of the prize to third parties shall not be accepted or managed.
SEVEN: ACCEPTANCE OF THE CONTEST RULES
The submission of the photograph by the contestants, and the provision of personal data, implies the user/contestant expressly, fully and unconditionally accepts the terms and conditions of this contest. SCHARLAB reserves the right to vary these contest rules, and if circumstances so require, resolve any doubts that may arise regarding what is not covered herein.
SCHARLAB reserves the right to freely disclose, and by any means or support, the proposals that have been submitted for participation in the contest. In this case, SCHARLAB shall identify the author of the same and the prize.
SCHARLAB, reserves the right to not award the prize if there are not enough participants and/or the quality of the submitted projects does not conform to the company's own values and/or image. This circumstance shall not represent the right to any claim on the part of the contestants who took part in this contest.
SCHARLAB also reserves the right to cancel, postpone, extend, shorten or modify the contest if circumstances so require, including the prizes, without having to justify the decision and without any claim of liability as a result, provided that they do not prejudice the rights acquired by the contestants.
Instagram, YouTube, Facebook or any other social network site do not sponsor, nor support nor manage, nor are associated in any way with this contest.
NINE: PROCESSING OF PERSONAL DATA
The contestants understand and agree that their personal data, including their image, shall be included in an automated data file property of SCHARLAB, under SCHARLAB’s responsibility. The purpose of this file is the adequacy and management of contestants in the contest, as well as the proper delivery of the prize, if applicable, to the winning contestant.
SCHARLAB shall proceed to the cancellation of said personal data once all the formalities necessary for the finalization of the contest have been made.
In compliance with contestant consent, SCHARLAB shall process the personal data that the contestants provide for (a) the correct management of the present contest, (b) the promotion of the Scharlau® brand and (c) to keep the contestant informed about products, services and future SCHARLAB or SCHARLAB Group promotional and advertising actions, directing said communications by any means, including via email.
SCHARLAB has implemented the necessary technical and organizational security measures to guarantee the security and integrity of the personal data provided by contestants.
At any time, the contest may exercise their rights of access, rectification, cancellation, limitation of use, transfer and opposition to use of their personal data, in writing, accompanied by a photocopy of the person’s Identity Card, and addressed to: SCHARLAB, C/ Gato Pérez, 33, Pol. Ind. Mas d'en Cisa, 08181 Sentmenat, Barcelona, (with the following reference: Data Protection).
In any event, for more information, all participants may consult the additional and detailed information on the Data Protection Policy in Annex I attached to these Legal Bases.
All those that appear in the photographs shall accept the transfer of their image rights to SCHARLAB. The project author, participating in the contest, shall be responsible for verifying that this requirement is met.
TEN: CEDING OF RIGHTS
The contestant, on submitting the photograph, guarantees to be the owner of the intellectual property rights of said photograph, that is to say, they are the material author of said photograph, which is original, and has not been plagiarized from third parties. Therefore, the contestant shall not hold SCHARLAB responsible against any third-party claim arising from breach of said guarantee.
By submitting the photograph to SCHARLAB, the user gives SCHARLAB any image and author rights they may have over it. Equally, the user grants SCHARLAB sufficient license for the rights to reproduction, distribution, transformation and public communication and making the photograph available for the time and the scope necessary to comply with the objectives established herein, without having any right or economic benefit for any of the participants.
A maximum period of three (3) months is established for receiving complaints that must be sent to the following postal address: C/ Gato Pérez, 33. PI Mas d'en Cisa. 08181 Sentmenat, Barcelona (with the following reference: (“YOUR PHOTOGRAPHS OF SCHARLAU PRODUCTS”); as such, after three (3) months from the date of completion of the promotion, no claim(s) shall be considered.
TWELVE: JUDICIAL JURISDICTION AND APPLICABLE LAW
Both SCHARLAB and the participants in this promotion, expressly renounce any jurisdiction that may correspond to them, and expressly submit themselves to the Courts and Tribunals of the city of Barcelona. The applicable Law shall be Spanish Legislation.

We inform you that we shall process your personal data for (a) the correct management of the present contest, (b) the promotion of the Scharlau® brand and (c) to keep you informed about the products, services and future promotional and advertising actions of SCHARLAB or the SCHARLAB Group (SCHARLAB, SL; SCHARLAU SCIENCE GROUP, SL, PATRIMONIAL SCHARLAU, SL, SCHARLAB ITALY, S.R.L LTDA, SCHARLAB BRAZIL, S Ltd, SCHARLAB PHILLIPINES, LTDA, SCHARLAB MAGYAR ORZÁG, KFT), sending said communication by any means, including by email. All those that appear in the photographs shall accept the transfer of their image rights to SCHARLAB. 3. GUARANTEE BY THE AUTHOR OF THE PHOTOGRAPHS/PROJECT
All those that appear in the photographs accept the transfer of their image rights to SCHARLAB and consent to the processing of their personal data as described herein. The project author, participant in the contest, shall be responsible for verifying that this requirement is met.
4. CRITERIA FOR CONSERVING DATA
Your personal data will held for the period strictly necessary for the successful implementation of the purposes outlined herein.
Specifically, your personal information (except the essential information for the photographs used in promoting the Scharlau® brand will be kept indefinitely at least until they cease to be of use for this purpose) will be kept for a maximum period of 5 years from the time of consent, all without prejudice to the fact that you have previously withdrawn your consent. Once the aforementioned period has elapsed, SCHARLAB shall block your personal data in order to prevent its processing, except for its availability to Public Administrations, Courts or Arbitration, in order to comply with any legal obligations that may arise.
Equally, we inform you that we shall take all reasonable measures to guarantee that your data is rectified or deleted when they are inaccurate.
5. ABSENCE OF AUTOMATED DECITIONS
SCHARLAB shall not take any automated decisions regarding the data that you provide us.
6. LEGITIMACY OF DATA PROCESSING
Processing your personal data has required your acceptance through which SCHARLAB can process them for the objectives stated herein.
7. OBLIGATION TO PROVIDE CERTAIN ESSENTIAL DATA
It is necessary you provide us with all the personal data that are identified as obligatory on the same form. In the event that you do not provide us with the information requested and identified as obligatory, SCHARLAB shall use all the means at its disposal to manage your request, without significantly impairing your rights to the attention of your request.
8. DATA DISCLOSURE
We inform you that your personal data shall not be communicated to third-party companies or other entities (except tax authorities in case the prize is subject to obligations regarding tax information).
9. INTERNATIONAL TRANSFER
Your personal data shall not be communicated to third companies established outside the European Union except in the case that they are processed by technological entities that provide a service for the purposes described and could process such personal data from outside the European Economic Area (for example, many social networks process personal data from the United States). In these cases, where there is said International transfers, they will always be made through the data protection guarantees provided for by regulations and you may contact SCHARLAB (by the same means to exercise your rights) to request more information regarding said matter.
10. RIGHTS OF INTERESTED PARTIES
You have the right to obtain information about the processing that SCHARLAB carries out on your personal data. Specifically:
- The user has the right to access their personal data to know what personal information we are processing that concerns you, as well as requesting the rectification of inaccurate data or, where appropriate, request their deletion when, among other reasons, the data is no longer necessary for the purposes that they were collected.
- In certain circumstances, the user may request the limitation of processing their data, in which case we will only keep them to carry out or for defence against claims.
- In certain circumstances and for reasons related to your particular situation, the user may oppose the processing of their data. SCHARLAB shall stop processing the data, except for compelling legitimate reasons, or to carry out or for defence against possible claims.
- The user shall have the right to transfer, that is to say, that the personal data provided, are transmitted directly to another entity responsible for them in a structured format, of common use and mechanical reading, when technically possible.
